Injury claims are pretty common, and so are the myths regarding them. Here are five that have seemed to take on a life of their own:
1. Injury claims are always long, tedious, and full of legal wrangling. That's simply not true. Many of them are settled quickly and quietly because people don't want to spend the time, effort, and money to continue to fight them. If a person or business knows that they are wrong, they will usually offer a settlement, simply to avoid the legal wrangling, with brings us to our second myth.
2. Legal battles are always required to settle injury claims. False. Injury claims are most commonly settled out of court, and only the most serious of them - and those where one party refuses to negotiate at all - actually go to court.
3. The victim of an injury can't have any treatment until the claim has been settled. Not true. If you're the victim of a personal injury you should get treatment right away. As long as the treatment is legitimate for your injury and not more than is actually necessary to help you recover, there should be no issue with you going ahead and getting treatment.
4. Having the facts in your favour means that you'll always get your money. Also not true. Just because it looks as though you should win your injury claim doesn't mean that you will actually win it. There are a lot of different things that come into play, and your facts and the facts that others can show might not be the same facts. Even if they are, it still doesn't mean that you'll get your money.
5. How much your claim is worth is up to you, so you should pick the highest amount you can. There are specific things that are 'worth' more than others. What kind of injuries you sustained, how severe they are, and whether they are permanent in any way will have a lot to do with how much money you can recover. Whether you're shown to be partially at fault can also affect it, as can many other things.
Those aren't the only myths when it comes to personal injury, but they're some of the most often talked about. By understanding that they're myths and not realities, you'll have a better chance at handling your claim effectively if you are ever injured and someone else is at fault.
